CAMBODIA: Trafficking maids to Malaysia

PHNOM PENH, 17 March 2011 (IRIN) - Investigations by NGOs in Cambodia have found that companies are recruiting girls as young as 13 to work in Malaysian households, confining them in overcrowded and unhygienic “training centres”, forging birth certificates to raise their age, and paying finders’ fees to brokers.

Hou Vuthy, a deputy director-general at the Ministry of Labour, said the government is moving swiftly to address the abuses and that “vast improvements” have been made.

He estimated it would take about three more years to fully control the recruiting companies, some of whom employed unscrupulous agents who “cheated” illiterate village residents. He stressed, however, that the government had already managed to eliminate the illegal recruiters.

Attention has focused on the burgeoning industry, and the firm T&P Co. Ltd. in particular, since one woman died at its “training” facility in suburban Phnom Penh and another broke bones in both of her legs while trying to escape from its third floor balcony.


She got entangled in the razor wire around the second floor, and then fell to the pavement, neighbours said. The three people who carried her off the street and comforted her while awaiting an ambulance were later summonsed to the local police station and interrogated by officers who accused them of colluding with the “trainees” to help them escape, neighbours said.

Tola Moeun, head of the Labour Programme at the Community Legal Education Centre, said the Ministry of Labour and the Department of Anti-Human Trafficking and Juvenile Protection were more concerned with protecting the recruitment agencies than the welfare of the more than 20,000 Cambodians who had been recruited to work as maids in Malaysia.

He said that in most cases he had investigated, the maids were under 21, and many were under 18. He alleged that officials at the commune level were falsifying birth certificates so that passports with false dates of birth could be issued by the Ministry of Foreign Affairs.

The Labour Ministry’s Vuthy admitted this had been happening, saying his office had no control over local officials and that it could not verify the authenticity of birth certificates that were delivered by the recruiting companies. He said, however, that the Ministry of Interior had cracked down on village and commune officials who forged documents. “That does not happen any more,” he said.

Government complicity?

MP and former minister for women’s affairs Mu Sochua has accused the government of complicity in trafficking.

“The Cambodian government has effectively legalized human trafficking,” Mu Sochua said. She also said the government was protecting the recruiting companies because some of its members might have financial interests in them.

Local media have reported more than 90 recruiting companies registered with the government, but Vuthy said there were 33, though they operate about 100 “training centres” in and around Phnom Penh. When asked if any companies were connected to the government, he replied: “It is legal in Cambodia for wives of politicians to run businesses,” but added, ownership is irrelevant because all companies must abide by the law.

Mu Sochua said some of companies brazenly violate the law. “The girls are being bought, documents are being forged; they are being imprisoned and abused in Cambodia, and then they are sent into an environment where there are no safeguards to protect them. Often their passports are confiscated and they are confined in households.”

The Cambodia Human Rights and Development Association (Adhoc) had warned in September 2010 that its investigation found severe cases of abuse at “training centres” in Phnom Penh and in Malaysia. Passports were being confiscated, maids were forcibly detained, and some were beaten, raped and tortured, Adhoc said.

Lobbying for legal age reduction

“This is probably just the tip of the iceberg,” said deputy director of the Asia division of Human Rights Watch, Phil Roberston. “There is also an overland route for smuggling Cambodian girls into Malaysia through Thailand.”

He also warned that efforts to lobby the Malaysian government to lower the legal age of maids from 21 to 18 were a “recipe for disaster”. “Our research has found that the younger the maid the more vulnerable they are to abuse and exploitation,” he said.

Vuthy said reports in Malaysian media that the Cambodian government was lobbying for a reduction in the age were fabricated by recruiting companies attempting to pressure Kuala Lumpur. Neither the Cambodian government nor the Malaysian government would give into their pressure, he said.

Recruitment companies in Malaysia set their sights on Cambodia in 2009 after Indonesia announced a freeze on sending new domestic workers to Malaysia, following reports of extreme abuse there.

Cambodian maids are more vulnerable because of the language barrier, greater cultural differences, the extreme poverty many came from, and the distance between the two countries, Robertson said.

Roberston said efforts by the international community to train Cambodian officials about trafficking had had little success. “Some top level officials go to seminar after seminar, while lower level officials receive little or no information on what trafficking is and how to prevent it. There is also a bigger problem of corruption among government officials, which is what we are seeing in relation to these labour recruitment schemes seeking to send maids to Malaysia.”

Vuthy sees things differently. He said his ministry was struggling with a surge in demand and a lack of experience and resources to monitor the industry. It was only last year that it produced its first orientation manual for migrant workers, he said.

“We’re learning quickly,” he said.

Subject: Cambodian Employment Agencies Providing Maids to Countries in the region

Dear Excellency Ambassador,

This letter is to inform you and the donor community of the serious situation related to the practices of employment agencies that provide training to Cambodians, in particular to under-aged women for employment in neighboring countries.

The death of a 36 year-old trainee in February 2011 was followed by another alarming incident when another trainee jumped off the third floor of T&P employment agency, two weeks later. Both families were detained against their will and forced to pay debts to the agency if they were to return to their villages.

Alarmed by the situation, my colleagues and I visited T&P agency on 10 March, accompanied by NGOs and the media.

We entered the company's premises with permission after we explained to its representatives the reasons of our visit.

Living and Working Conditions and Debts

We were alarmed by the high tin-sheets and barbered wires that closed the building off, giving us the impression of imprisonment. We were granted permission to speak to the 100 or so trainees as we were informed that the military police had interviewed five trainees who had requested to leave the company.


MP, Mu Sochua was able to identify one- Srun Channa, 23 year-old, of the five trainees. I inspected the rooms were the trainees live. 30 trainees share a 4mx6m room, on 3 floors. I was told later by a trainee that the under-aged trainees were kept in a separate room on the 3 rd floor.

We negotiated successfully for the release of Srun Channa as the company and its lawyer insisted that her parents be present to sign guardianship papers. It is in fact, the debts of US$350 that the parents must pay back to the company for the cost of training, passport etc. to travel to Malaysia.

Srun Channa was not released till 11 March with intervention from the City prosecutor.

Company's Protection by Local Authorities

Local district councilors, criminal police and prosecutors intervened on behalf of the company, accusing us of illegal entry and demanding our leave. MP, Mu Sochua was pushed to the side by the deputy-district governor, while acknowledging that he knew who MP, Mu Sochua is.

Local authorities and police ignored the law that forbids detention against one's will. Furthermore, local authorities accepted the company's practice of debts and the charges for food, lodging and extra fees.

There was no sign that the local authorities even attempt to defend the rights of the trainees who are detained against their will. There are tremendous pressures on the young women to comply with the rules of the company.

Officials of the Ministry of Labour

No officials from the Labour Ministry were present during the two days of our visit, despite promises made.

We can conclude that the Labour Ministry leaves it up to the companies to draw guidelines and those inspections of the premises and the application of the laws are very weak and that negligence from the part of the government led to the deaths and injuries of the women.

Claiming that the company is under investigation by the Court, the Labor Ministry and local authorities are waiting for results of the investigation.

Under-aged Recruitment and Falsification of Documents

With the collaboration of the Community Legal Education Center (CLEC), and our local networks, we investigated the cases of the four trainees who were supposed to have been released by the company. They were in fact detained inside the company when during our visit.

Two out of the trainees went home but the papers they are holding were actually falsified by the company and its recruiters. Both women are under 18 years of age. The requirement for Malaysia is 21 years old to be employed as maids.

Two other trainees returned to their villages as they are suspected to be detained by the company at its centre in Kompong Chnang.

Actions to be Taken

As Members of Parliament, we have requested to the Prime Minister to allow the Minister of Labor to answer to the following inquires, with the presence of the Minister in Parliament;

1/ The Families’ debts to Employment Companies

We propose that this practice be stopped immediately

And that clear guidelines be drawn up by the government according to the laws.

2/ Working and Living Conditions

We propose improvement for health and safety of the trainees. Company’s premises should not be locked and that trainees be free to leave at their own will.

3/ Under-aged Trainees

We propose a strict inspection of the recruitment of the trainees and for prosecution in case of violation.

4/ Suspension and/or Dissolution of T&P License to Operate

We propose that T& P license be suspended when under investigation and that all its three centers are closely monitored till the end of the investigation.

5/ Confiscation of trainees Documents

We propose that all confiscations of trainee’s family books, I.D cards and other vital documents be prohibited.

We hope that your Embassy will take part to help in preventing these violations of human rights by informing your government as well as to raise this situation with the Cambodian government so that a very close monitoring system can be set up in order to stop all forms of exploitation and abuses of the workers.

We are further concerned by the lack of protection of Cambodian workers in your country where there have been reporting that abuses of workers have occurred but workers cannot get help since their passports were confiscated by employers and no information provided to workers on how to get help and in a number of cases, workers were arrested when try to escape and were thrown in Malaysian’s jail.

We acknowledge the role of Malaysian government in playing its part to prevent such crimes from happening by closely monitoring the connection in which the company such as T&P has with Malaysian counterpart and set the regulations to protect foreign workers in Malaysia.

Singers and actors are eagerly joining the ongoing donation rush to help Japanese victims hit hard by the recent devastating earthquakes.

Actors Lee Byung-Hun donated 700 million won and Ahn Jae-wook gave 100 million won to the Korean Red Cross.

"Lee thinks life is the most important thing among others. He hopes his donation helps many Japanese victims suffering from the natural disaster", his agency BH Entertainment said.

"The natural disaster comes against human's will but the power to overcome it depends on our strength and will. I hope there are no more victims", Lee said in his homepage on March 13.

Lee gained huge popularity for numerous hit Korean television dramas such as "IRIS", "All In" and "Beautiful Days" and films such as "G.I. Joe: The Rise of Cobra", "A Bittersweet Life" and "JSA - Joint Security Area".

Ahn said, "My heart hurt when I think of how the Japanese victims are still fearful of the dangers of aftershocks and explosions of the nuclear complex facilities amid the increasing death toll and those who are missing. I was thinking about how to help them and I decided to give a donation to the Korean Red Cross to practically provide assistance".

Ahn rose to stardom with "Star in my Heart" and then pursued a singing career releasing albums "Forever", "Memories", " Yesterday " and "Red in Ahn Jae-wook".

The Korean Red Cross has operated a taskforce consisting of 40 staff members to help the Japanese victims from March 15.

Meanwhile, popular boy band JYJ consisting of Jun-su, Hero Jae-jung and Micky Yoochun, former members of TVXQ, donated 600 million won to international relief agency World Vision. The donation will be used for the aid and reconstruction of the quake-stricken cities and to organize a shelter for child victims.

The band will continue their relief efforts in the long term through world tour concerts to raise awareness of plight of Japanese victims. The band will operate the SNS site (www.facebook.com/jyjworldtourconcert) to share supportive messages and hold donation programs in cooperation with World Vision and its fans from various countries.

In an aid to cheer his Japanese fans up after the recent earthquake, tsunami and nuclear explosions in Japan, Rain offered some words on his official website. Posted on the 14th of March, Rain updated his official homepage with the title "Hi, Everyone. This is Rain."

On the said update, Rain wrote: “First of all, I would like to offer my heartfelt condolences and consolation for all the people in Japan. I know that they’re having a very hard time due to such a tremendous natural disaster. I feel as if it could happen to me and my heart bleeds a lot more for them, especially as I’ve often visited that country. I am sure that if we combine our strength, these difficulties could be overcome.”

Further more, he encouraged his fans with a final statement stating, “I hope all of Japanese Cloud fans are all right, and I’d like to offer words of consolation again.”

Meanwhile, following in their idol's footsteps, Rain's official fanclub "The Cloud" has conducted a charity campaign to help the earthquake victims in Japan. Boasting members from other countries such as United States, Canada, Germany, Poland, China, Hong Kong and many others, the fanclub was reported to have reached an estimate of 15 million won for their website charity campaign.

Yesterday i shared a link of a blog on my facebook and well decided to share it with my readers as well.
